Payment
Terms, Nicholas Teti III, Mister Photon Media
If
you are a client that pays upon agreed schedules, worry
no further. I, Nicholas Teti have had to implement a
policy on individuals whom have not payed in the past
and due to some rather substantial defaults. This legal
notice below is not directed at anyone in particular,
just those whom would prefer not to pay for my services,
and for all those good people out there apologies to
have to imply any character or point any fingers, as
the notice below is only for those whom do not agree
to pay for my services.
I
prefer great client relationships from the start and
I also understand some personal circumstances may occur
financially as well, but if you do business with me,
Nicholas Teti III, Mister Photon Media LLC you are expected
to pay within the time frames negotiated with me / Nicholas
Teti III / Mister Photon Media LLC
Please
don't assume I prefer taking clients or customers to
court or enjoy calling collection agencies, as I would
rather extend reasonable measure to allow payment grace
periods as opposed to developing bad relationships in
business either. I absolutely hate having to refer people
or businesses to collection agencies when they default
as it's a losing situation for them and myself - so
the best business is to pay upon agreed terms.
In
return, you receive one of the most experienced, qualified
location sound & production people in the state;
whom you will enjoy working with with the best equipment
in sound & camera resources.
Payments
Payment
is due upon the invoice due date. New clients may be
expected to pay upon completion of labor/services, or
within 2 weeks or may be granted a 30 day payment schedule
pending the type of corporation; based on decision of
Nicholas Teti III / Mister Photon Media LLC. Call in
advance to negotiate payment terms and I will happy
to email you a formal cost in writing for your records.
If Nicholas Teti III / Mister Photon Media LLC arranges
other time schedules on payment terms; these terms may
be extended but never exceeding 60 days from contract
services completion. First time clients may be required
to pay in advance or upon shoot completion pending resources
hired & rented from Nicholas Teti III / Mister Photon
Media LLC.
Payment
terms will always be disclosed / discussed in advance
to you & your company as well prior to my location
services.
An
emailed invoice will be provided within one day after
the services are completed to you / your company. Included
information via Nicholas Teti III / Mister Photon Media.
The invoice will consist of company information, EIN
/ TIN information via the email, labor & any equipment
description, date & location. As well the agreed
upon payment schedule terms will be included on the
invoice for your records.
It is your responsibility to promptly forward all invoices
and agreed upon expenses to your accounting department
for payment and by hiring of Nicholas Teti III / Mister
Photon Media LLC and you / your company is responsible
for for the payment schedule terms from the date of
the submitted invoices via Nicholas Teti III / Mister
Photon Media LLC by email.
The contract payment schedule terms will begin from
the day after completion of labor, unless if the payment
is due upon the labor completion in which instance an
invoice will be provided promptly or in advance. If
you require a quote via email for contract purposes,

Every
contract is expected to be paid in full for my services
upon the due date of the invoice provided to you. There
is a 7 day grace period from the due date on the invoice.
If
you default of Payment to Nicholas Teti III / Mister
Photon Media LLC
IF
you default on payment you/your company are liable for
100 % of the contract cost and the additional costs
listed below this paragraph in the section "Legal
Fees". These terms are in place for any verbal
or written contract or modified contract. Modified contracts
include additional agreed upon services,
time, equipment rentals, additional supplies requested
etc. Examples
of modified contacts include additional days, time,
resources rented, equipment rented or provided, expenses
added, or personnel hired during the services provided
to you. For another example, if you hire me & my
resources and request additional equipment while on
production there may be additional costs for equipment
or supplies.
Any
additions and assignments will be negotiated in advance,
or can be negotiated as needed. Mister Photon Media
/ Nicholas Teti III, will email you a formal cost quote
prior to providing labor & services to you / your
company, and by working with Nicholas Teti III / Mister
Photon Media you must read and agree to these terms
in advance.
You
are also responsible for the following additional costs
if you default on payment:
LEGAL
FEES SECTION (if you default on payment)

If you/your company defaults on contract or payment
you / your company is responsible for all additional
collection costs, fees, legal costs, court fees, attorney
fees and costs, and interest along with the principle
amount already owed. Any additional, fees or cost or
interest charged to me is your responsibility if you
/ your company defaults on payment. You may be extended
on a grace period if I determine a valid excuse for
non payment on scheduled due dates.
Again,
I prefer not to have to take people or companies to
court, and prefer long term repeat relationships, so
just pay on time with diligence. EASY.
In
Advance Communications
I
am happy to email any formal costs for labor and equipment
and costs for any overtime fees if they incur or additional
expense charges in advance prior to providing my services
- but call as I may on location and not be available
immediately by email.
Nicholas
Teti III / Mister Photon Media llc will inform you of
any additional costs during the retainment of services
if additional resources, labor time, labor, equipment
or expenses are requested by you while I am providing
service. Calling to discuss in advance your production
and any potential overtime is encouraged.
Nicholas Teti IIi / Mister Photon
Media LLC will not add additional costs to any contracts
in good terms unless agreed upon verbally or in writing.
Defaults
on payments are given the benefit of doubt. If it is
apparent after inquiries that you / your company does
not honor the contract terms collections will be implemented
unless a reasonable excuse is provided to Nicholas Teti
III / Mister Photon Media. Reasonable excuses
are deemed on a case by case basis solely by Nicholas
Teti III.
All these terms are standard with any established businesses
and my company always strives to please our clients
and do the best job for every client.

Labor
with or without production equipment, including cameras,
tripods, mixers, sound equipment, lighting equipment,
grip equipment, monitors, backgrounds, digital audio
recorders and personnel

Rates
/ Costs
Rates
are based on equipment resources brought, combined with
time. Anything under 5 hours is considered a half day
within local services areas. Rates past 5 hours billed
up to 10 hours are a full day before overtime charges.
Overtime is a additional hourly rate charged. Travel
time and expenses may be charged or included based on
the start location, or travel time to the beginning
of your production. Call in advance to discuss all production
locations with me.
TIME
Any time less than 5 hours is the applicable
half day rate. Any time past5 hours is considered a
full day rate. Any time past 10 hours is overtime and
negotiated in advance.
